BiteAdvocates — Waiver & Release of Liability Agreement

This Agreement is entered into between the undersigned parent or legal guardian ("Client") and BiteAdvocates, including its founder and any independent contractors, consultants, or advocates engaged by BiteAdvocates (collectively, "Contractors"), in connection with special education consulting and/or advocacy services ("Services").

1. Description of Services

Services may include, but are not limited to: reviewing educational records and evaluations; explaining IEP/504 plans and special education rights; consulting by phone or video; preparing Client for IEP/504 meetings; and attending IEP/504 meetings alongside Client in a supporting, non-representative capacity.

2. Independent Contractor Status

Client understands that any Contractor providing Services is an independent contractor and not an employee, partner, or agent of any school district, agency, or other organization. BiteAdvocates is not responsible for the independent acts, omissions, advice, or conduct of any Contractor beyond what is required by law.

3. No Attorney-Client Relationship / Not Legal Advice

Client understands that BiteAdvocates and its Contractors are not attorneys (unless separately and expressly identified as such in writing), that Services do not constitute legal advice or legal representation, and that no attorney-client relationship is formed through these Services. Client is encouraged to consult a licensed attorney for legal advice or representation.

4. No Guarantee of Results

Client understands that BiteAdvocates and its Contractors cannot and do not guarantee any specific result, outcome, decision, service, or accommodation from any school, district, or agency. Outcomes depend on many factors outside of BiteAdvocates' control.

5. Assumption of Risk

Client voluntarily assumes all risks associated with participating in the Services, including risks arising from decisions made using information or guidance provided, and from Client's own representations, decisions, and communications with third parties.

6. Release and Waiver of Liability

To the fullest extent permitted by applicable law, Client, on behalf of themselves, their child/student, and their heirs, hereby releases, waives, and discharges BiteAdvocates, its founder, and its Contractors from any and all liability, claims, demands, or causes of action arising out of or in connection with the Services, except to the extent such claims arise from gross negligence or willful misconduct.

7. Indemnification

Client agrees to indemnify and hold harmless BiteAdvocates and its Contractors from third-party claims arising out of Client's use of the Services, to the extent permitted by law.

8. Confidentiality of Student Records

Client authorizes BiteAdvocates and its Contractors to review, discuss, and retain copies of the student's educational records solely for the purpose of providing the Services, and agrees such records will be handled with reasonable care and confidentiality.

9. Governing Law & Severability

This Agreement is governed by the laws of the state in which BiteAdvocates operates. If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full effect.

10. Acknowledgment

By completing and submitting the form below, Client acknowledges that they have read and understood this Agreement, are signing it voluntarily, are at least 18 years of age, and are the parent or legal guardian of the student named below with authority to enter into this Agreement on the student's behalf.
